In the letter, they praised the commission's attempts to maintain Federal jurisdiction over prediction markets and asked to end the practice of regulation through punishment, instead calling for clearer guidance and not punitive responses.This request represents a significant desire for legal certainty from the sector, which would allow marketplace participants to be able to scale operations without the concern that they will face contradictory or retroactive rules. <h2>Why This Matters</h2> <ol><li data-list="bullet">Prediction markets provide opportunities for participants to bet on outcomes of specific events such as political elections or commodity prices. Prediction markets also exists in an intersection of regulations related to derivatives law, gaming law, and securities. This creates a lot of uncertainity about how prediction markets will be regulated.</li><li data-list="bullet">The Digital Chamber's objective in developing a dedicated working group is to:</li><li data-list="bullet">Increase the presence of crypto-native prediction markets in the policy discussion</li><li data-list="bullet">Ensure that the CFTC will continue to be the primary regulatory agency and that there will be consistent and uniform regulation across the United States.</li><li data-list="bullet">Prevent state regulatory agencies from forcing consistent and uniform regulations at the state level that will stifle innovation by imposing counterproductive restrictions on prediction markets.</li></ol> <h2>Broader Implications</h2>If successful, this effort could create a precedent for how the U.S. regulates specialized financial products in blockchain by establishing a balance between protecting consumers and fostering innovation. Furthermore, this could drive the development of compliant prediction markets leading to investment opportunities in those markets from a broader base of institutional investors. Through the establishment of its Prediction Markets Working Group, the crypto industry demonstrates an active commitment to working cooperatively with regulators. The group’s goal is to create a more reliable and stable legal regime in which prediction markers can prosper, as well as to protect prediction market participants and uphold the integrity of the overall financial system, by advocating for federal level regulation and the establishment of clear guidance from regulators.
